Administrative Monetary Penalties

The Administrative Monetary Penalty System (AMPS) is a municipal alternative to the provincial court system that administers and adjudicates by-law offences. The AMPS program of enforcement transfers identified by-law disputes from the courtroom to the municipality.

If you receive a penalty notice, you must choose one of the following options by the due date on the penalty notice. An administrative fee is payable if the fine goes into default and the information may be provided to a credit bureau or added to your municipal taxes. 

When you receive a penalty notice, you may:

1. Pay your penalty notice: pay over the phone by credit card, by mail to the address on your penalty notice, or in-person at 6 Oak Street, Lancaster; OR

2. Submit a request for a screening review to dispute a penalty notice on or before the date on which the Administrative Penalty is due and payable. No appointment is necessary. 

3. If you have not requested a review by a Screening Officer on or before the date on which the Administrative Penalty is due and payable, you may Request an Extension to Obtain a Screening. This may be e-mailed or mailed to the Township office. Note that this option expires after 45 days of the Penalty Notice date (the date of the contravention specified on the Penalty Notice).

Appealing a Screening Review Decision

You may appeal a screening review decision by requesting a review by a Hearings Officer. You must submit your appeal request within 30 days of issuance of a screening decision. 

If you have not requested a Review by a Hearings Officer on or before the date on which the Administrative Penalty is due an payable, you may Request an Extension to Obtain a Hearing. This request may be e-mailed or mailed to the Township office. Note that this option expires after 45 days of the date of the screening decision.

Frequently Asked Questions

Penalty notices are issued for violations of the Township’s By-laws as provided in the AMPS By-law. The penalty notice contains a fine and a due date. You must respond to the penalty notice by the due date shown by either paying the fine amount, requesting a screening review or an extension to obtain a screening. Failure to respond to the penalty notice by the due date shown may result in additional fees and the information may be provided to a credit bureau or added to your municipal taxes.

Municipal Law Enforcement Officers can issue a penalty notice by doing any of the following:

  • Handing it to the person to whom it is addressed
  • Sending it by mail to the person’s last known address
  • Sending a copy by facsimile transmission to the person’s last known facsimile transmission number
  • Sending a copy by email to the person’s last known email address

There are three options to pay a Penalty Notice:

  • Pay by Phone: Call (613) 347-1166 to make a payment by credit card. Please have your Penalty Notice number ready.
  • By Mail: Write the Penalty Notice number on the front of your cheque or money order, make payable to "The Township of South Glengarry" and mail to: Planning. Building & Enforcement Division, 6 Oak Street, Lancaster, Ontario, K0C1N0. Do not send cash by mail. Post-dated cheques or payments by installments will not be accepted. NSF cheques will be subject to an additional administrative fee.
  • In Person: Monday to Friday, 8:30 am to 4:00 pm at 6 Oak Street, Lancaster.

If requested, a Screening Officer will review the administrative penalty contained in a penalty notice. Screening reviews are conducted internally after the request form is received. The Screening Officer may affirm, vary or cancel the administrative penalty.

  • If requested, a Hearings Officer will review the decision of the Screening Officer. The Township’s AMPS By-law outlines the grounds upon which a Screening or Hearings officer may affirm, vary or cancel the administrative penalty.
  • Screening and hearings officers are appointed by Council.

If you do not attend a scheduled hearing review appointment and you have not requested an Extension to Obtain a Hearing, the penalty notice will be confirmed and additional fees will be added and the information may be provided to a credit bureau or added to your municipal taxes.

The fee for failure to appear at a scheduled hearing review appointment is $100.

If the matter is still in dispute following the review by the Screening Officer, you may request a review by a Hearings Officer. A request for a hearing must be made prior to the due date outlined in the Screening Officer’s decision using the Hearing Request Form. It is important to note that you may only appeal the Screening Officer’s decision and must do so within 45 days after the screening decision date and that only the information/evidence submitted at the screening will be considered at the hearing. The decision made by the Hearings Officer is final.
